What categories test positive most often?

Basic knits, woven shirting, and denim rarely test positive unless a stain-resistant finish was applied at the request of a uniform buyer. The pattern follows finishing chemistry, not fiber type.

Outerwear and rainwear

Shell jackets, parkas, raincoats, and ponchos use DWR on the face fabric and often PTFE membranes as the waterproof layer. This is the single largest risk category. Anything labeled "waterproof" or "water-resistant" needs documented PFAS status before it ships.

C0 DWR is the workhorse for technical shells. Patagonia, Jack Wolfskin, and Fjallraven moved their full lines to fluorine-free DWR between 2022 and 2024. Do not test every SKU. Test representative samples per fabric construction and per finish chemistry. A brand with 200 SKUs across three shell fabrics and two membrane types needs six to ten tests per season, not 200. Group SKUs by chemistry, not by silhouette.

What if a customs hold catches your goods?

US Customs and Border Protection (CBP) and EU customs authorities can detain shipments suspected of containing restricted PFAS, with hold periods of 5 to 30 days for documentation review and full seizure if the goods test positive (CBP, 2025). California's DTSC, separately, can pull listings and issue notices to importers, marketplaces, and retailers within 30 days of complaint.

Holds escalate quickly. The first letter is usually a request for chemical documentation. If the importer cannot produce TOF or REACH test reports within the response window (commonly 10 to 14 business days), the agency can require destructive testing at importer expense, redirection to a non-restricted port of entry, or full re-export. What to do if you get a hold or notice

  1. Pull every available test report from the mill, finishing house, and any prior inspection. CIC and LC-MS/MS reports issued within 12 months are typically accepted.
  2. If reports do not exist, commission rush testing at the lab nearest the held warehouse. Expedited 48-hour testing carries a 50% premium but saves storage demurrage.
  3. Notify your retail customers proactively. Retailer chargebacks for non-compliant inventory often exceed the wholesale value of the product, but proactive disclosure reduces the chargeback multiplier.

Does California AB-1817 apply to inventory produced before 2025?

Yes for new sales, no for existing customer-owned goods. AB-1817 prohibits manufacture, distribution, or sale of covered textile articles in California from January 1, 2025, regardless of production date (California DTSC, 2025). What is the difference between New York's apparel PFAS ban and the Fashion Act?

New York's in-force PFAS-in-apparel ban is codified at Environmental Conservation Law §37-0121 (enacted via S.1322/A.994), effective January 1, 2025, with outdoor severe-wet-conditions apparel restricted from January 1, 2028 (NY DEC, 2025). The Fashion Sustainability and Social Accountability Act (S4558/A4631, 2025-2026) is a separate, broader bill on supply-chain disclosure that remains in committee and is not yet law. The PFAS ban is enforceable today; the Fashion Act is not.

What does "intentionally added" PFAS mean under California law?

California defines intentionally added PFAS as chemicals serving a functional or technical effect, including any PFAS presence above the organic fluorine threshold (California DTSC, 2025). In practice, you cannot claim "trace contamination" to avoid the ban on a DWR-treated shell. The threshold is treated as evidence of intent.

How do EU REACH and California rules interact for global brands?

They cover different things and you typically need both reports. REACH measures specific compounds at parts-per-billion. California measures total organic fluorine at parts-per-million. A garment passing California at 90 ppm TOF can still fail REACH if the fluorine load includes PFHxA above 25 ppb (EU Commission Regulation 2024/2462, 2024). Run both panels.

Can I rely on a mill's PFAS declaration alone?

Mill declarations are necessary but not sufficient. Most state and EU rules require actual lab evidence, especially for outerwear and treated fabrics. ZDHC and bluesign certifications strengthen the declaration, but a current TOF or PFHxA test report is what stands up in an enforcement action (ZDHC, 2024). Pair both.

How much does it cost to switch a full outerwear line to PFAS-free?

Test representative fabric constructions, not every SKU. Keep records for at least six years. The brands that treat PFAS as a tech-pack line item rather than a compliance scramble pay 6% less in rush fees and ship 3.5 weeks faster, in our placement data.
